Terms of Service

1. Acceptance

By creating an account or using Brandswarm ("Service"), you agree to these Terms. If you don't agree, don't use the Service.

2. The Service

Brandswarm tracks brand mentions across AI platforms (ChatGPT, Claude, Gemini, Perplexity, Google AI Overviews, and others). Results depend on third-party AI responses; we don't guarantee accuracy or completeness of AI-generated content.

3. Your account

  • You must be 18 or older.
  • Keep your account secure — you're responsible for all activity under it.
  • One organization per account owner. You may invite team members per your plan limits.

4. Acceptable use

You may not:

  • Use the Service to scrape or resell data without written permission.
  • Submit prompts designed to harm, harass, or defame individuals or organizations.
  • Circumvent rate limits or abuse the scan infrastructure.
  • Attempt to reverse-engineer, copy, or create derivative works of Brandswarm.

5. Billing

Subscriptions are billed monthly or annually via Stripe. All prices are in USD. The 14-day free trial applies to your first subscription only. Refunds are issued at our discretion; in general, we don't charge for periods you didn't use. Cancel any time — no surprise fees.

6. Intellectual property

You own the prompts and brand data you enter. We own the Brandswarm platform, design, and codebase. You grant us a licence to process your data to provide the Service.

7. Disclaimers

The Service is provided "as is". We don't warrant uninterrupted uptime or that AI scan results are accurate. AI outputs are probabilistic and may change without notice.

8. Limitation of liability

To the maximum extent permitted by law, our liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may cancel any time via the billing settings page.

10. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in New Jersey.

11. Changes

We'll notify you by email of material changes at least 14 days before they take effect. Continued use after the effective date = acceptance.
